Jini ” application offers a service (hereinafter the “ Jini ”) intended to enable people looking for a means of transport to a given destination (hereinafter: the “Customers”) to be put in touch with a taxi, a chauffeur-driven car operator or a company registered in the departmental transport register (hereinafter: the “Drivers”).
Customers and Drivers are hereinafter jointly referred to as “Users”.
The purpose of these general Customer conditions is to define the terms and conditions of use of the services for connecting Customers with Drivers offered on Jini (hereinafter: the “Services”) as well as to define the rights and obligations of the parties in this context.
They are accessible and printable at any time on Jini , as well as via a direct link at the bottom of the page of the website www.taxijini.com (hereinafter: the “Site”).
They may be supplemented where appropriate by specific conditions of use for certain Services, which supplement these general conditions and, in the event of contradiction, prevail over the latter.
Subject to the approval of the General Terms, Jini is granted to the user as a license (and not assigned), solely for personal and non-commercial use. The license granted to the user is limited to a non-exclusive and non-assignable or transferable license to use Jini .
Jini Operator
Jini , the Site and the Services are operated by the company JINI X, SARL (AU) with a share capital of 100,000 Moroccan Dirhams, registered with the RC of the Court of First Instance of Dakhla under number 13457, whose head office is located at 961 Bd HASSAN II Hay ELMATAR –DAKHLA, MOROCCO (hereinafter: “ Jini ”). 3. Access to Jini
3.1 Legal capacity
Jini and the Services are accessible exclusively to individuals aged over 18 and with full legal capacity to enter into these general conditions.
3.2 Downloading Jini
jini is usable on mobile phones and tablets, in IOS and Android operating systems .
The User who wishes to use the Services must download Jini from the appropriate application download platform.
This download is subject to the terms of use specific to said platform.
3.3 Accessibility of Services
Jini reserves the right, at its discretion, to only offer the Services on certain days and/or at certain times and, more generally, to interrupt the Services at any time, without having to provide any reason.
Users may not exercise any recourse or request any compensation in this regard.
4. General conditions
Acceptance of these general conditions is materialized by the validation of the button provided for this purpose when first accessing Jini . This acceptance can only be full and complete. Any adhesion subject to reservation is considered null and void. The User who does not agree to be bound by these general conditions must not access Jini or use the Services.
5. Registration
5.1 To use the Services, the User must be registered on one of the third-party sites indicated on Jini and use his/her login details for said third-party site to register on Jini . He/she must then provide Jini with any additional information requested. The User expressly authorizes Jini to access his/her account data on the third-party site concerned.
The User must provide Jini with all the information indicated as mandatory. Any incomplete registration will not be validated.
In this regard, the User must provide his/her bank details in order to use the Services. However, Jini reserves the right, at its discretion, not to oppose the use of the Services in the absence of bank details provided by the User.
Registration automatically results in the opening of an account in the name of the User (hereinafter: the “Account”), giving him/her access to a personal space (hereinafter: the “Personal Space”) which allows him/her to manage his/her use of the Services in a form and according to the technical means that Jini deems most appropriate to provide said Services.
5.2 By default, the Account created during the User's registration is a Customer Account.
The User who also wishes to use the Services as a Driver must make a request to Jini , through the form provided for this purpose, and subject to also accepting the general conditions of use provided for this purpose, in Jini or on the Site. When his request is accepted, his Account is also validated by Jini as a Driver Account.
5.3 The User must provide Jini with all requested information and documents.
He is solely responsible for the accuracy of this information and documents and in particular the bank details that he provides to Jini , which may in particular be used for, as the case may be, the payment or payment of the Final Price provided for in article 6.2 and the payment or payment of the fixed costs mentioned in article 8.2.5 in the event of damage to the Driver's vehicle, where applicable.
For the purposes of transparency, improving trust, or preventing or detecting fraud, Jini reserves the right to carry out any verification and to ask the User to provide any useful document to justify the information provided during registration.
In particular, Jini reserves the right to refuse any Trip (as this term is defined below) whose distance to be covered exceeds 40 km. If the Trip whose distance to be covered exceeds 40 km is accepted via the Application, the Driver ensures that the identity of the Customer corresponds to that communicated to Jini . The Customer accepts that access to or use of the Services may be refused if he refuses to provide proof of his identity, or if it does not correspond to that communicated to Jini . Jini declines all responsibility in the event of fraud, if the Driver is unable to provide proof that the identity of the Customer corresponds to that communicated to Jini .
The Client authorizes in advance his bank to debit his bank account for the amount appearing on the statements sent by Jini , corresponding to the receipt at the end of the Service.
Jini informs the User of the acceptance or refusal of his request for validation of his Account by email.
Jini reserves the right to refuse any request, at its discretion and without having to provide any reason.
The User whose request is refused may not exercise any recourse or request any compensation.
5.4 The User may access his Personal Space at any time after identifying himself using his login ID and password.
The User undertakes to use the Services personally and not to allow any third party to use them in his place or on his behalf, unless he bears full responsibility for them.
He is responsible for maintaining the confidentiality of his username and password. He must immediately contact Jini using the contact details mentioned in Article 2 hereof in the event that his Driver Account is used without his knowledge or is likely to be used. He acknowledges Jini 's right to take all appropriate measures in such cases.
6. Description of services
The User has access to the following Services, in a form and according to the functionalities and technical means that Jini deems most appropriate.
6.1 Connecting Passengers and Drivers
Drivers available to pick up Passengers must log in to Jini .
The Customer who wishes to make a journey (hereinafter: a “Journey”) must also connect to Jini and enter their departure address as well as their arrival address.
In particular, Jini reserves the right to refuse any Journey (as this term is defined below) whose distance to be covered exceeds 40 km under the conditions specified in 5.3.
The Customer chooses whether or not to validate his request. If he validates it, it is sent to all Drivers near the departure address who are connected to the Application. They have 30 seconds to accept or not the request. At the end of this period, the Driver closest to the departure address who accepted the request is selected to pick up the Customer. The Drivers and the Passenger are informed via Jini of this selection. If no Driver accepts the Customer's request, the Customer is also informed via Jini .
6.2 Prices and billing
JINI X via Jini offers a Theoretical Price (as this term is defined below) to carry out the Journey. If the Customer accepts it, he must have previously ensured that all the information displayed is consistent with the desired Journey. Jini transmits to the Driver who has agreed to carry out the Journey the elements of the Journey. The theoretical price of the Journey is announced in advance and takes into account: the pick-up, the distance to be covered, and the duration of the Journey (the "Theoretical Price "). When the Customer validates the Journey request, Jini sends him at least a photo of the driver and the vehicle, the estimated arrival time of the vehicle and the Theoretical Price of the Journey. The arrival time provided by JINI X via Jini is indicative and based on standard times and cannot engage its responsibility. At the request of the Customer, Jini transmits the information relating to the Order stored in the service provider's database. After validation of the Journey, the Customer must present himself at the agreed place. The Driver may not take charge of the Customer if he/she is intoxicated, in the presence of an animal weighing more than 8 kg and not placed in a cage, in the event of a danger to the safety of the driver and the vehicle, or if the number of Customers exceeds the capacity of the vehicle, or if the Customer does not have the mandatory equipment necessary for transporting a young child (the "Unfit" Customer), without this decision giving rise to any right to compensation whatsoever for the benefit of the Customer concerned. The Customer's pick-up may be cancelled by the Driver under the following conditions:
the Customer is Unfit, the Customer does not show up, or in the event of force majeure. The Customer will receive a notification to warn them of this. When dropping off the Customer, the Driver must indicate this on Jini , which then geolocates the arrival address and indicates to the Customer, depending on the journey taken, a final amount including tax (hereinafter: the “Final Price”).
The Final Price charged to the Passenger will be calculated when the execution of the Journey is completed and may include additional services requested by the Customer: stops, layovers, detours, change of destination. The Customer has the option of paying the Final Price to the Driver: - Through Jini , in which he will have previously provided his bank card number to the Driver in cash at the end of his Journey, The Customer must indicate his choice to pay the Contribution to Costs by bank card or in cash at the time of ordering on the Application. For any means of payment returned unpaid or for any late payment, the remaining amounts due will be increased by 50 Dh as a penalty. In all cases, regardless of the method of payment chosen, in the absence of payment of the Final Price at the end of the Journey and regularization within twenty-four hours following the end of the Journey, the amount of the Final Price will be automatically debited from the bank account that he will have provided when registering on the Application. The payment of the Final Price, as well as the collection made in the event of damage to the Driver's vehicle provided for in Article 8.2.4, is implemented by the secure payment service provider " Stripe ", which alone keeps the Users' bank details for this purpose. Jini does not keep any bank details. Once the Journey has been completed, the Services are the subject of receipts which are communicated to the Passenger by email.
6.3 Driver Comments
At the end of the Trip, the Customer can make comments on the Driver and evaluate him. These comments and evaluations may be published anonymously on Jini , which also displays the average of the Driver's evaluations.
6.4 Other Services Jini reserves the right to offer any other Service that it deems useful, in a form and according to the functionalities and technical means that it deems most appropriate to provide said Services.
6.5 Cancellation of the Order by the Customer
6.5.1 Free cancellation
The Customer may cancel the Immediate Order free of charge as long as this cancellation is made less than 5 minutes after placing the Order. After the 5-minute period, the Customer retains the option to cancel the Order, but is liable to cancellation fees of 35Dh. Paid cancellation by the Customer also covers the situation in which the Customer (or the person(s) for whom the transport was ordered) does not appear in front of the vehicle within 5 minutes from the moment Jini informed him/her of the Driver's arrival at the address indicated by the Customer. The Customer may be notified of the invoicing of these fees before he/she confirms his/her wish to cancel the Order.
6.5.2.1 Payment of cancellation fees
The Customer has the option to pay the cancellation fees: • If the Customer has previously entered his or her credit card number in the application, Jini will directly charge the amount of the fees to the Customer's account. • If the Customer has not previously entered his or her credit card number, the Customer may pay these cancellation fees by (1) entering a credit card number in the application or (2) paying via a secure link that will be sent to him or her by Jini .
Jini reserves the right to revoke the right to use the application from any Passenger who has not paid these cancellation fees.
7. Express waiver of the right of withdrawal
Customers are informed that a right of withdrawal applies in principle to contracts for the provision of services concluded remotely between a professional and a consumer, this right being to be exercised within 14 (fourteen) days from the conclusion of the contract. They are however expressly informed and accept that the Services are provided to them upon registration and are thus fully executed before the end of the withdrawal period referred to above. Consequently, they expressly waive their right of withdrawal, which may therefore not be exercised, in accordance with the Consumer Protection Act.
8. User Obligations
Without prejudice to other obligations provided for herein, the User undertakes to comply with the following obligations.
8.1 Obligations common to all Users
8.1.1 The User undertakes, in his use of the Services, to respect the laws and regulations in force and not to infringe the rights of third parties or public order.
8.1.2 The User is solely responsible for his/her use of the Services and in particular for the relationships he/she may establish with other Users and the information he/she communicates to them within the framework of the Services. It is his/her responsibility to exercise appropriate prudence and discernment in these relationships and communications.
The User also undertakes, in his/her exchanges with other Users, to respect the usual rules of politeness and courtesy.
8.1.3 The User undertakes to provide Jini with all information necessary for the proper execution of the Services.
More generally, the User undertakes to cooperate actively with Jini with a view to the proper execution of these terms and conditions.
He guarantees that all the information he provides when registering or requesting validation of a Driver Account is accurate, up to date and sincere and is not tainted by any misleading nature. He also guarantees that it does not in any way infringe the rights of third parties, in particular personality rights and intellectual property rights. He undertakes to update this information in his Personal Space in the event of modifications, so that it always corresponds to the aforementioned criteria.
8.1.4 The User is informed and accepts that the information entered for the purpose of creating or updating his Account constitutes proof of his identity. The information entered by the User is binding upon him as soon as it is validated.
In particular, the User accepts that his information may be verified as provided for in article [5].
8.1.5 The User must take the necessary measures to save by his own means the information in his Personal Space that he deems necessary, no copy of which will be provided to him.
8.1.6 The User is informed and accepts that the implementation of the Services requires that he be connected to the internet and that the quality of the Services depends directly on this connection, for which he is solely responsible.
8.2 Obligations specific to Passengers
8.2.1 Passengers who have validated a trip request and have been informed of the selection of a Driver to carry it out undertake to present themselves at the departure address or, in the event of cancellation, to inform the Driver and, where applicable, Jini by any useful means, as soon as possible.
8.2.2 Passengers are required to pay the Driver the Final Price in accordance with the terms set out in Article 6.2.
In the event of a repudiated payment, if the means of payment used for payment is not in the name and surname of the Passenger, the Passenger will be required to reimburse the amount or the Final Price of the journey made by a professional, in Jini .
8.2.3 Passengers are required to wear their seat belts. A fine is incurred by persons caught failing to do so during a check by the police.
8.2.4 In the event of damage to the vehicle attributable to the Passenger, the service provider will re-invoice the Passenger for the costs of repairing the vehicle or changing equipment at a fixed amount of €100 including tax. In the event of more significant repairs, the Passenger may be required to pay a higher amount based on the supporting documents presented by the Driver. Payment of the amount due in the event of damage to the vehicle will be automatically debited from the bank account that the Passenger provided when registering on the Application.
9. User Warranty
The User guarantees Jini against any complaints, claims, actions and/or demands whatsoever that Jini may suffer as a result of the violation by the User of any of its obligations or guarantees under these general conditions. He undertakes to compensate Jini for any damage it may suffer and to pay it all costs, charges and/or sentences that it may have to bear as a result.
10. Prohibited behaviors
10.1 It is strictly prohibited to use the Services for the following purposes:
- the exercise of illegal, fraudulent activities or activities that infringe the rights or security of third parties
- breach of public order or violation of laws and regulations in force
- intrusion into a third party's computer system or any activity likely to harm, control, interfere with, or intercept all or part of a third party's computer system, or violate its integrity or security,
- sending unsolicited emails and/or commercial prospecting or solicitation,
- manipulations intended to improve the referencing of an application or a third-party site
- assistance or encouragement, in any form and in any manner whatsoever, to one or more of the acts and activities described above and more generally any practice diverting the Services for purposes other than those for which they were designed.
10.2 Users are strictly prohibited from copying and/or diverting for their own purposes or those of third parties the concept, technologies or any other element of Jini .
It is therefore particularly prohibited to insert any part of Jini on a mirror site without the prior written consent of Jini , or to use any meta tag or code or other device containing any reference to Jini in order to direct a person to another application or another website, whatever the reason.
10.3 The following are also strictly prohibited:
- any behavior likely to interrupt, suspend, slow down or prevent the continuity of the Services
- any intrusions or attempted intrusions into Jini systems
Jini or Site system resources
- any actions likely to impose a disproportionate burden on the latter's infrastructure
- any breach of security and authentication measures
- any acts likely to harm the financial, commercial or moral rights and interests of Jini or the users of its Application, and finally, more generally, any breach of these general conditions
10.4 It is strictly prohibited to monetize, sell or grant all or part of access to the Services or to Jini as well as to the information hosted and/or shared therein.
10.5 It is strictly forbidden to create multiple User accounts.
11. Sanctions and breaches
In the event of a breach of any of the provisions of these general conditions or, more generally, of an infringement of the laws and regulations in force by a User, Jini reserves the right to take any appropriate measure and in particular to:
• suspend access to the Services of the User who committed the breach or infringement, or who participated in it
• delete the account of the User who committed the breach or offense, or who participated in it
• publish on Jini or on the Site any information message that Jini deems useful
• notify any relevant authority
• initiate any legal action, and in particular any action necessary to recover amounts owed for the use of the Services. In the event of a breach by the User of an essential obligation arising from these general conditions, Jini reserves the right to terminate its access to all or part of the Services, with immediate effect, by letter, fax or email. Termination takes effect automatically on the date on which Jini sends the written notice addressed to the User in application of this clause. It automatically and without prior notice entails the deletion of the User's Account, without prejudice to any other consequences that may result from the application of these general conditions.
12. Jini ’s liability and warranty
12.1 Jini undertakes to provide the Services diligently and in accordance with the rules of the art, it being specified that it has an obligation of means, to the exclusion of any obligation of result, which the Users expressly acknowledge and accept. The Services are provided “as is” and “subject to availability”.
12.2 Jini does not provide transportation or logistics services and does not act as a carrier. All such transportation services are provided by independent third party providers who are not employed by Jini or any of its affiliates.
Jini acts solely as a broker in that it provides Passengers and Drivers with tools and technical means enabling them to enter into relationships for the purposes of transport between individuals. Its liability is limited to providing these means, as described herein, and to putting Passengers and Drivers in contact. Jini acts in its own name and does not enter into any legal act in the name and on behalf of the Passengers or Drivers, who agree to perform the Journeys and perform them directly between themselves. Jini is not a party to the relationships between Passengers and Drivers and does not intervene in any way in the Journeys, their quality, safety, location, payment or schedules, subject to the provisions of Article 3.3.
Jini may not under any circumstances be held liable for any difficulties that may arise during the conclusion or execution of the Journeys, nor be a party to any possible disputes between a Passenger and a Driver concerning in particular the guarantees, declarations and any other obligations to which the Passenger or the Driver may be bound.
However, in an effort to constantly improve the quality of the Services, Jini invites Users to provide it with any comments and information they may wish to bring to its attention regarding the quality of transactions carried out through the Services.
12.3 Jini does not guarantee in any way the accuracy of the geolocation carried out through Jini , which only aims at basic localization actions. It is up to Users to verify and correct their location if necessary and, in the case of Passengers, to accurately provide their departure and arrival addresses.
12.4 Jini declines all responsibility in the event of any loss of information accessible in the User's Personal Space, the latter having to save a copy and not being able to claim any compensation in this regard.
12.5 Jini undertakes to carry out regular checks to verify the operation and accessibility of Jini .
In this respect, Jini reserves the right to temporarily interrupt access to Jini for maintenance reasons. Similarly, Jini cannot be held responsible for temporary difficulties or impossibilities of accessing Jini that may originate from circumstances beyond its control, force majeure, or that are due to disruptions to telecommunications networks.
12.6 Jini does not guarantee to Users
(i) that the Services, subject to constant research to improve in particular their performance and progress, will be totally free from errors, defects or faults,
(ii) that the Services, being standard and in no way offered for the sole intention of a given User based on his or her own personal constraints, will specifically meet his or her needs and expectations.
12.7 In any event, the liability that may be incurred by Jini under these terms is expressly limited to only proven direct damage suffered by the User.
13. Intellectual property The systems, software, structures, infrastructures, databases and content of any nature (texts, images, visuals, music, logos, brands, databases, etc. ) operated by Jini X within Jini and the Site are protected by all intellectual property rights or rights of database producers in force.
Any disassembly, decompilation, decryption, extraction, reuse, copying and more generally, any act of reproduction, representation, distribution and use of any of these elements, in whole or in part, without the authorization of Jini are strictly prohibited and may be subject to legal action.
14. Personal data Jini practices a personal data protection policy, the characteristics of which are explained in the document entitled “Charter relating to the protection of personal data”, which the User is expressly invited to read.
In accordance with Dahir No. 1-09-15 of February 18, 2009 promulgating Law No. 09-08 on the protection of individuals with regard to the processing of personal data, Jini collects your personal data for the purpose of connecting taxis for the benefit of customers. The data will be communicated to our subcontractor.
Each member has the right to access, modify, rectify and oppose data concerning them.
To exercise it, simply contact customer service on +212 6 78 50 80 80 , which is open all week from 10 a.m. to 6 p.m., and provide your name, first name, address, username, as well as a certain amount of information related to your activities (last journey, etc.) in order to secure the call.
15. Advertising Jini reserves the right to insert in any place on Jini or on any page of the Site any advertising or promotional messages in a form and under conditions of which Jini will be the sole judge.
16. Links and third-party sites Jini may not under any circumstances be held responsible for the technical availability of websites or mobile applications operated by third parties (including its potential partners) which the User may access via Jini or the Site.
Jini assumes no responsibility for the content, advertisements, products and/or services available on such third-party sites and mobile applications, which are reminded to be governed by their own terms of use.
Jini is also not responsible for transactions between the User and any advertiser, professional or trader (including its potential partners) to whom the User may be directed through Jini or the Site and may not under any circumstances be a party to any potential disputes with these third parties, particularly concerning the delivery of products and/or services, guarantees, declarations and any other obligations to which these third parties are bound.
17. Duration of services, unsubscription
The Services are subscribed for an indefinite period. The User may unsubscribe from the Services at any time, by sending a request to this effect to Jini by email, to the contact details mentioned in Article 2. Unsubscription is effective within a maximum period of 7 (seven) days from this request. It results in the automatic deletion of the User's Account.
18. Modifications Jini reserves the right to modify these general conditions at any time. The User will be informed of these modifications by any useful means.
Any User who does not accept the amended general conditions must unsubscribe from the Services in accordance with the terms set out in Article 18. Any User who uses the Services after the amended general conditions come into force is deemed to have accepted these modifications.
19. Entry into force These general conditions entered into force on January 20, 2024.
